Conservatorship vs. Guardianship in Oregon

Conservatorships and guardianships are similar in that they are established to appoint a trusted individual to make decisions on behalf of a mentally or physically incapacitated person. They differ in the types of decisions that can be made. A guardianship will typically establish the right to make legal, medical, and personal decisions, whereas a conservatorship will typically address the right to manage financial affairs.

Appointing a Guardian or Conservator

Levine Law Center has experience protecting the needs of people who can no longer make decisions for themselves due to age or physical/mental incapacity. In such cases, we can:

  • Obtain a determination from a qualified professional that the person lacks the physical and/or mental capacity to manage his or her own affairs;
  • Establish the qualifications of the guardian or conservator and help you find a trusted person who can fulfill these; andf
  • Set forth the terms and scope of the guardianship or conservatorship.
